General aQuickCheck

The following general terms and conditions apply to the use and purchase of products/services of our app and website aQuickCheck. You should note that by using our app and website you agree to the content of these general terms and conditions and you are also bound to comply with these general terms and conditions (the "Agreement").

Introduction

Please read the following basic rules that apply to your use of the aQuickcheck website and our aQuickCheck app. You are subject to the rules, guidelines, policies and conditions. aQuickCheck reserves the right to modify the app and website and these general terms and conditions at any time. For this reason, we recommend you read these general terms and conditions each time you use the app and website.

Use of the app and website

By accepting these general terms and conditions through your use of the app and website, you confirm that you are 12 years of age or older. If you are under 12 years old, you may only use the app and website under the supervision of a parent or legal guardian who agrees to be bound by these general terms and conditions. aQuickCheck does not intentionally collect personal information about children under 12 years old. If you are a parent or legal guardian and agree to these general terms and conditions on behalf of a child under 12 years old, please note that you are fully responsible for their use or reuse of the app and website. This includes all financial costs and legal liability that may result from such use or reuse. If you do not agree with (or cannot comply with) any of these terms, do not use the app or website. All billing and registration information provided must be truthful and accurate. Providing false or inaccurate information may constitute a breach of these general terms and conditions. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the requested service(s).

You are solely responsible for access to and use of the app and website by anyone using the password and identification originally assigned to you, whether or not such access to and use of this site is actually authorized by you, including but not limited to all communications and transmissions. This applies to all obligations (including but not limited to financial obligations) arising from such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You must immediately notify aQuickCheck of any unauthorized use of your password or identification or any other breach or threatened breach of the security of the app or website.

Conduct of members and users

Upon registration you receive a password and an aQuickCheck ID. You are responsible for maintaining the confidentiality of the password and ID, and you are fully responsible for all activities that occur under your password or ID. You agree to:

(a) immediately notify aQuickCheck of any unauthorized use of your password or account or any other security breach, and

(b) ensure that you log out of your account at the end of each session. aQuickCheck cannot and will not be liable for any loss or damage resulting from failure to comply with this requirement.

You acknowledge and agree that all information, code, data, text, software, music, sound, photos, images, graphic images, video, chat, messages, files or other materials ("Content"), whether posted publicly or sent privately, are solely the responsibility of the person from whom such content originates. This means that you, and not aQuickCheck, are fully responsible for all content you upload, post, email or otherwise transmit through the services. aQuickCheck has no control over the content of users or third parties posted through the products and services, and therefore does not guarantee the accuracy, integrity or quality of such user or third-party content. You acknowledge and agree that by using the products and services you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will aQuickCheck be liable at any way to any user, including, but not limited to, for any errors or omissions at such content, or for any loss or damage of any kind arising from the use of such content. This applies to all content posted, emailed or otherwise transmitted through the products and services. In general, aQuickCheck does not pre-screen users posted on aQuickCheck, except at certain areas where aQuickCheck uses certain automated screening software, although aQuickCheck reserves the right to do so. aQuickCheck does not guarantee that screening will be performed to your satisfaction or that screening will be performed at all. aQuickCheck reserves the right to monitor some, all or none of the products and services for compliance with these general terms and conditions or other rules or guidelines placed by aQuickCheck.

Reviews and comments

Unless otherwise stated elsewhere at this Agreement or on the app or website, anything you submit or post on the app or website and/or provide to aQuickCheck, including but not limited to ideas, know-how, techniques, questions, reviews, comments and suggestions (collectively "Submissions") are and will be treated as non-confidential and non-proprietary. By submitting or posting, you agree to irrevocably license the submission and all related IP rights (except for moral rights such as copyright) to aQuickCheck free of charge. aQuickCheck has the royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt and create derivative works from such Submissions. aQuickCheck also has the right to translate, modify, reverse engineer, disassemble or decompile such submissions at any form. All submissions automatically become the sole and exclusive property of aQuickCheck and will not be returned to you, and you agree not to raise any disputes at the future regarding any use of the submission by aQuickCheck.

In addition to the rights that apply to any submission, when you post comments or reviews on the app or website, you also grant aQuickCheck the right to use the name you provide with a review, comment or other Content, if present, at connection with such review, comment or other content. You may not use a false phone number or email address, misrepresenting yourself as anyone other than yourself. aQuickCheck may, but is not obligated to, remove or edit submissions (including comments or reviews) for any reason.

Copyrights and trademarks

All text, graphics, photos or other images, button icons, audio clips, logos, slogans, trade names or word software belong to aQuickCheck. You may not use, reproduce, copy, modify, transmit, display, publish, sell, license, publicly perform, distribute or commercially exploit or otherwise the content without express prior written permission from aQuickCheck. The use of data mining, robots or similar tools for collecting and extracting data, as well as the use of aQuickCheck trademarks or service marks at meta tags is strictly prohibited. You may only view and use the Content for your personal data on the app and website and for no other purpose. The collection, organization and compilation of all content on the app and website (the "Compilation") belongs exclusively to aQuickCheck. You may not use the content or compilation of aQuickCheck at a manner that discredits aQuickCheck or at a manner likely to cause confusion or violation of applicable laws or regulations.

Force majeure

aQuickCheck cannot be held responsible for delays at service access caused by other parties. aQuickCheck is, however, still obligated to take all necessary measures to expedite the delivery of the service. If delivery is delayed for more than 4 weeks, aQuickCheck has the right to cancel the service delivery.

General

We may from time to time modify the general terms and conditions that apply to your use of the app and website. Your use of the app and website after such a modification means you agree to follow and be bound by the modified terms. We may from time to time modify, move or remove parts of the app and website, or add something to it.

User input

All comments, feedback, suggestions, ideas and other submissions that are made public, submitted or offered to aQuickCheck on or through the app or website or otherwise made public, submitted or offered at connection with your use of the app or website (collectively "submissions") are and remain the property of aQuickCheck. Such publication, submission or offer of comments constitutes a transfer to aQuickCheck of all worldwide rights, titles and interests at all copyrights and other intellectual properties at the comments. aQuickCheck is the exclusive owner of all such rights, titles and interests and will not be limited at any way at using them, commercially or otherwise, of any comments. You agree that no comment you post on the app or website will infringe any third party right. You further agree that no comment you post on the app or website will be defamatory or otherwise unlawful, offensive or obscene material or contain such material. You are and remain solely responsible for the content of any comments you make.

Pricing

Prices may be changed without prior notice. We have done everything to ensure that our prices are 100% true to the designer's pricing policy; however, we cannot honor typographical errors.

Termination

This agreement is at force unless and until it is terminated by you or aQuickCheck. You may terminate this agreement at any time. aQuickCheck may also terminate this agreement at any time and may do so immediately and without prior notice, and accordingly deny you access to the app or website if you do not comply with any term of this agreement at aQuickCheck's discretion. Upon any termination of this agreement by you or aQuickCheck, you must immediately destroy all downloaded or otherwise obtained materials from the app or website, as well as all copies of such materials, whether made under the terms of this agreement or otherwise. You also agree that if the agreement is terminated, whether by you or aQuickCheck for any reason, no refund of any subscription fees already paid will be made.

Taxes, excise duties, fees

aQuickCheck cannot be held responsible for any additional costs such as taxes, levies, fees or brokerage fees that may apply to international orders. Normally we mark the package with a low value to avoid import duties, but policy varies at different countries. Therefore, contact your local government if you want to know if any of these apply.
